OVERVIEW

Welcome to Aino Home. These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). These Terms constitute an agreement between you and Aino Home.

These Terms apply to consumers purchasing for personal or household use. If you are purchasing for business purposes, please contact us at info@ainohome.fi for separate B2B terms.

Please read these Terms carefully. They include important information about your legal rights, including your statutory right of withdrawal, warranty rights, and limitations of liability.

By using our Services, you agree to our Terms and our Privacy Policy. If you do not agree, you should not use our Services.


SECTION 1 — ACCESS AND ACCOUNT

You may use our Services without creating an account. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

You may not transfer, sell, or assign your account to any other person.


SECTION 2 — OUR PRODUCTS

We make every effort to accurately represent our products. However, colors and appearance may differ depending on your device and settings.

Your statutory rights are not affected by this section. If a product you receive does not match the description or is defective, you have rights under the Finnish Consumer Protection Act (Kuluttajansuojalaki), including the right to have the defect remedied, a price reduction, or cancellation of the purchase. We cannot limit these rights by contract.

We reserve the right to discontinue products and to limit quantities.


SECTION 3 — ORDERS

How a contract is formed: When you place an order, you make an offer to purchase. The contract is formed when we send you an order confirmation by email.

Payment timing: Consistent with Finnish consumer law, we will not charge you for an order before the contract is formed. If your payment is processed at the time of ordering, we will only capture the payment after we send the order confirmation.

We reserve the right to decline an order for valid reasons (e.g., product unavailability, suspected fraud). If we decline your order, we will notify you and refund any payment without undue delay.

Your purchases are subject to our Returns and Refund Policy, which forms part of these Terms.


SECTION 4 — PRICES AND BILLING

Prices are as shown at the time of order confirmation. Prices include VAT where applicable. Shipping costs are shown separately before you complete your order.

We reserve the right to correct pricing errors. If a pricing error is discovered after order confirmation, we will notify you and you may cancel the order.

Payment methods: We offer at least one commonly used payment method without additional costs. Payment methods are presented in the order required by Finnish law.


SECTION 5 — SHIPPING AND DELIVERY

Delivery options: We offer delivery to Posti parcel lockers, Matkahuolto, and other service points throughout Finland, as well as home delivery. You may select your preferred pick-up point at checkout.

Delivery times: Estimated delivery times are shown at checkout and in your order confirmation. While we strive to meet these estimates, delays may occur due to circumstances beyond our control (e.g. carrier disruptions, customs, weather).

Our responsibility: Under Finnish consumer law, we bear the risk of loss or damage during delivery until you or your designated representative receives the goods. We cannot contractually shift this risk to you.

If your order is delayed beyond a reasonable time, you may be entitled to cancel the purchase and receive a refund under the Finnish Consumer Protection Act.


SECTION 6 — YOUR STATUTORY RIGHT OF WITHDRAWAL (14 DAYS)

As a consumer in Finland/the EU, you have the right to withdraw from your purchase within 14 days without giving any reason.

When the period starts: The 14-day period begins on the day you (or a third party you designate, other than the carrier) receive the goods. For multiple goods delivered separately, it begins when you receive the last item.

How to withdraw: You may send us a clear statement by email to info@ainohome.fi. Merely returning goods does not constitute withdrawal — you must notify us first.

Return shipping: You are responsible for the direct cost of returning goods, unless we have agreed otherwise or failed to inform you of this before purchase. If you choose a delivery method more expensive than our cheapest standard option, we will only refund the standard cost.

Refunds: We will refund all payments received, including the cheapest standard delivery cost, within 14 days of receiving your withdrawal notice. We may withhold the refund until we have received the goods back or you have provided proof of return .

Condition of goods: You may inspect and handle goods as you would in a physical store. You are liable for diminished value resulting only from handling beyond what is necessary to establish the goods' nature, characteristics, and functioning.

SECTION 7 — DAMAGES AND DEFECTS

If you receive a defective, damaged, or incorrect item, please contact us immediately at info@ainohome.fi. Your rights under the Finnish Consumer Protection Act and Product Liability Act are not affected by these Terms. You may be entitled to:

  • Correction of the defect at no cost
  • Price reduction proportionate to the defect
  • Cancellation of the purchase and refund

We cannot contractually limit these statutory rights.


SECTION 8 — INTELLECTUAL PROPERTY

All content on our Services (trademarks, text, images, designs) is owned by Aino Home or our licensors and protected by intellectual property laws.

You may use our Services for personal, non-commercial purposes. You may not reproduce, distribute, or exploit our content without prior written consent.


SECTION 9 — THIRD-PARTY SERVICES

Our Services may integrate with or link to third-party services (e.g., payment processors, carriers, Shopify). We are not responsible for the acts or omissions of third parties beyond our control. Your use of third-party services is subject to their own terms.


SECTION 10 — RELATIONSHIP WITH SHOPIFY

Aino Home is powered by Shopify. However, all sales are made directly between you and Aino Home. Shopify is not responsible for any aspect of sales between you and Aino Home, including any injury, damage, or loss resulting from purchased products.


SECTION 11 — PRIVACY

Our Privacy Policy explains how we collect, use, and protect your personal data. We comply with the EU General Data Protection Regulation (GDPR) and Finnish data protection law.


SECTION 12 — FEEDBACK AND REVIEWS

If you submit feedback or reviews, you grant us a non-exclusive, royalty-free license to use, reproduce, and display such content in connection with our Services.

Reviews: Where we display consumer reviews, we comply with Finnish law requiring disclosure of whether and how we verify that reviews come from consumers who have actually purchased or used the product. This information is provided in Finnish and in the same interface as the reviews. If we offer incentives for reviews, this is clearly disclosed.


SECTION 13 — PROHIBITED USES

You may not use our Services for unlawful purposes, to infringe intellectual property rights, to harass others, to transmit malware, or to engage in automated data extraction without permission.


SECTION 14 — TERMINATION

We may suspend or terminate your access to the Services if you materially breach these Terms. If we terminate for reasons other than your breach, we will refund any prepaid amounts for services not yet provided.

You may stop using our Services at any time.


SECTION 15 — DISCLAIMER OF WARRANTIES

Your statutory rights are not affected by this section.

The Services are provided “as is” for informational purposes. We do not warrant that the Services will be uninterrupted or error-free.

We do not exclude or limit our liability for statutory warranty rights under the Finnish Consumer Protection Act, including the right to receive goods that conform to the contract and the right to remedies for defects.


SECTION 16 — LIMITATION OF LIABILITY

Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence
  • Product liability under the Finnish Product Liability Act
  • Intentional misconduct or gross negligence
  • Any other liability that cannot be limited or excluded under mandatory Finnish or EU consumer law

To the extent permitted by law, our total liability for direct damages arising from your use of the Services shall not exceed the amount you paid for the product giving rise to the claim.

We are not liable for indirect or consequential damages (e.g., lost profits) except where such damages are recoverable under mandatory consumer law.


SECTION 17 — INDEMNIFICATION

You agree to indemnify us against third-party claims arising from your breach of these Terms or your unlawful use of the Services.


SECTION 18 — SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force.


SECTION 19 — CHANGES TO TERMS

We may update these Terms for valid reasons (e.g., legal changes, new features). We will notify you of material changes by email or prominent notice on our website at least 30 days before they take effect.

If you do not agree to the changes, you may stop using the Services. Continued use after the effective date constitutes acceptance.

Changes will not retroactively affect your statutory rights in relation to purchases already made.


SECTION 20 — GOVERNING LAW AND DISPUTES

These Terms are governed by Finnish law, without prejudice to mandatory consumer protection rules in your country of residence.

Your right to your local courts: Nothing in these Terms prevents you from bringing proceedings in the courts of your habitual residence in Finland or another EU Member State.

Consumer dispute resolution: You may contact the Finnish Consumer Advisory Services (Kilpailu- ja kuluttajavirasto) or the Consumer Disputes Board (Kuluttajariitalautakunta) for assistance.
